BAROCK is a trademark operated and distributed by B SÉLECTION.

VAT not applicable pursuant to Article 293 B of the French General Tax Code.

Article 2 - Scope

These General Terms and Conditions govern all sales made through the website www.barock.fr.

The products offered on this website are intended exclusively for professional customers, including:

  • Retail stores
  • Concept stores
  • Wholesale buyers
  • Distributors
  • Resellers

By placing an order, the Buyer fully accepts these Terms and Conditions.

Article 3 - Products

The essential characteristics of the products are described on the website.

Photographs, illustrations and product descriptions are provided for informational purposes only and are not contractually binding.

BAROCK products are manufactured in limited quantities. Product availability is subject to stock and production capacity.

Article 4 - Minimum Order Requirements

Minimum opening order:

Minimum reorder:

€300

B SÉLECTION reserves the right to refuse any order that does not meet these minimum requirements.

Article 5 - Prices

Prices are stated in Euros (€).

All prices displayed on the website are exempt from VAT.

In accordance with Article 293 B of the French General Tax Code:

VAT not applicable.

Shipping costs are charged separately and will be indicated before order confirmation.

B SÉLECTION reserves the right to modify its prices at any time. Orders will be invoiced according to the prices in force at the time the order is placed.

Article 6 - Availability

Orders are fulfilled subject to product availability.

Should a product become unavailable after an order has been placed, the Buyer will be informed as soon as possible.

Article 7 - Payment Terms

Orders are payable according to the payment terms specified at checkout or stated on the invoice.

Accepted payment methods may include:

  • Bank transfer
  • Credit card
  • Any other payment method approved by B SÉLECTION

Orders shall not be considered final until payment has been received or approved.

Article 8 - Late Payment

Any late payment shall automatically result in late-payment penalties under applicable French commercial law.

In addition, a fixed recovery fee of €40 shall be payable pursuant to Article D.441-5 of the French Commercial Code.

Article 9 - Delivery

Products are shipped to the delivery address provided by the Buyer.

Delivery times are provided for informational purposes only.

B SÉLECTION shall not be held liable for delays caused by carriers, customs procedures, force majeure events or circumstances beyond its reasonable control.

Risk transfers to the Buyer upon delivery of the goods to the carrier.

Article 10 - Receipt of Goods

The Buyer must inspect the goods immediately upon receipt.

Any damage, shortage or discrepancy must be reported to both the carrier and B SÉLECTION within forty-eight (48) hours of delivery.

Article 11 - Returns and Claims

As transactions are conducted exclusively between professionals, no statutory right of withdrawal applies.

No return of goods shall be accepted without the prior written approval of B SÉLECTION.

Approved returns must be sent back in their original condition and packaging.

Article 12 - Retention of Title

Ownership of the goods shall remain with B SÉLECTION until full payment of the invoice has been received.

Until ownership is transferred, the Buyer may not pledge, transfer or otherwise dispose of the goods without prior written consent from B SÉLECTION.

Article 13 - Intellectual Property

The BAROCK trademark, logos, photographs, product designs, catalogues, marketing materials and all website content remain the exclusive property of B SÉLECTION.

Any reproduction, distribution or use without prior written authorization is strictly prohibited.

Article 14 - Personal Data

Personal data is processed solely for the purposes of order management, customer relations and compliance with legal obligations.

In accordance with the General Data Protection Regulation (GDPR), users have the right to access, rectify, restrict or delete their personal data.

Article 15 - Force Majeure

B SÉLECTION shall not be held liable for failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to:

  • Natural disasters
  • Epidemics or pandemics
  • Strikes
  • Supply chain disruptions
  • Transportation disruptions
  • Government actions

Article 16 - Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with French law.

Any dispute relating to the interpretation, validity or performance of these Terms and Conditions shall fall under the exclusive jurisdiction of the competent French courts.
